Terms & Conditions

Please read these terms and conditions carefully as they act as your Agreement of booking. All booking requests are considered to be an acceptance of these conditions.
Bookings made through our online booking system are provisional until confirmed by us.

Your contract

1. We are Bellbird Estates Ltd registered at First floor, 85 Great portland Street, London, W1W 7LT United Kingdom. Bellbird Estates is the owner of Dale House with whom your contract for the provision and use of the accommodation is made on behalf of yourself and all other persons named in the booking, and references to “you” and “your” include reference to all such persons. The contract incorporates these terms and conditions.

2. Your contract with Bellbird Estates will apply when we issue an email to you confirming your booking and when we receive your deposit.

3. All bookings are subject to the availability of the accommodation which we will confirm before accepting a booking from you.

4. You must be at least 21 years of age to make a booking with us.

Pricing errors and web site content

5. We will confirm the price of the accommodation when we confirm its availability. If the price as advertised on our web site is incorrect, we will not be under any obligation to accept a booking at the advertised rate. We reserve the right to correct any pricing errors on our website and the booking will be offered to you at the correct price.

6. Images and descriptions on the Dale House website and any other 3rd party websites are provided by us and our managing agents and we try to keep them as up to date as possible. However we will not be held liable for any incorrect or inaccurate information or for any 3rd party websites that have not been updated.

Payments

7. We will require a deposit of 25% of the total price which will be payable within 48 hours of our confirmation of availability, after which the property may be made available for an alternative booking.

8. The booking deposit is non-refundable except where your booking is cancelled by the owner when clause 14 below shall apply.

9. The remaining 75% of the price will be payable no later than 60 days before your scheduled arrival at the house. Failure to pay on time may result in your booking being cancelled and the house made available for alternative bookings. Your booking and deposit will be lost.

10. For bookings made within 60 days of your scheduled arrival at the house, payment will be due in full. This must be paid within 48 hours of confirmation of availability after which the property may be made available for an alternative booking.

11. We hold a €200 security deposit through your credit/debit card 7 days before your arrival. Our payment processor ‘holidayrentpayment’ will store your card details from when you made your initial booking deposit payment to be able to automatically place the holding security deposit. This hold will be removed 7 days after departure providing no damages/negligence is found. (See ‘Your responsibilities’ pt 18 – 26, for what could be charged.)
Failure to obtain this security deposit before your arrival date may result in your booking being cancelled and the denial of entry to the house. In the event of such cancellation, the house owner shall be entitled to retain all money already paid and shall be under no liability to you.

Amendments and Cancellation Policy

12. You shall be entitled to make any reasonable amendment to the booking up to 60 days before arrival, subject to the consent and acceptance of the house owners. An administration charge of £30 will be charged per amendment.

13. If you cancel your booking, we shall be entitled to retain the deposit. and to charge a cancellation charge of £50. If you have already paid the balance of the price, such money will be refunded according to when the cancellation is made, subject at all times to the owners right to withhold and retain the cancellation charge.

14. In the event of the cancellation of your booking by the owner (except by reason of clause 11 above), you will be entitled to a full refund of all money which you have already paid for the accommodation, excluding any insurance premium and excluding any administration fees already paid for an amendment to the booking in accordance with clause 12 above, but no compensation shall otherwise be payable by us.

14.a. COVID – 19 cancellation policy

In the extreme event of another lockdown, you will be offered the opportunity to postpone your trip to a later date *Subject to the dates being available, and valid for 1 year from the date of original stay. If there is a difference in fare for the new dates i.e high season, different time of year etc, the difference in price will be added onto the booking and will need to be paid according to the terms & conditions.

Use of the property

15. You agree that the number of people staying in Our Property will not exceed the maximum number stated on the website.

16. You agree that Our Property will be used for personal and domestic purposes only. You shall not use the property for any commercial purpose. We reserve the right to terminate without notice and without refund for a breach of this condition.

17. You agree that Our Property will not be used for any activity or in such a way as to cause a nuisance or annoyance to neighbours of the property.

Your Responsibilities

18. You are responsible for any and all costs, expenses or other financial outlay incurred by the house owner which arises directly or indirectly from any loss or damage to the house and which results from your negligence and/or the negligence of any other person in the house with your permission. Any existing damage found at the house upon your arrival must be immediately notified to us, otherwise it will be deemed to have arisen during the period of your use of the house.
For damages that are not covered by a damage deposit, we have the right to issue an invoice for reimbursement of costs for any damages reported to us by our changeover team as a result of negligence during your stay.

19. Waste removal – All dishes, pots and pans must be cleaned and put away and the house left in a clean & tidy condition. No food to be left in the property. All rubbish must be removed from the premises upon departure and placed in the appropriate bins at the back of the property. Failure to do so will incur a service charge of up to £100.

20. Parties & Events: Care should be taken to look after the property & it’s furnishings. Any damages to walls, fixtures & fittings or furniture will result in a surcharge or loss of part/full damage deposit.
No stag parties allowed.
Please respect the neighbours and keep noise to a minimum after 9pm. Trespassing to any neighbour properties and gardens is not allowed.

21. Keys & parking permits: We will issue you with keys to the property. Parking permits for the car park opposite are bought by us yearly and provided with the house. Please ensure all keys & parking permits are placed back inside the house upon departure. The main key needs to be placed back inside the lockbox.
Any missing keys or parking permits will be charged for. If you lock yourself out of the property you will need to recover the cost of the emergency call out and/or replacement keys, or we will deduct it from your security deposit/pre-authorised card.

22. Insurance: You are responsible for obtaining travel and any other relevant insurance to protect you and your belongings for the duration of your stay at the house and/or your travel to and from the house.

Cots & High chairs

23. A travel cot and highchair are provided. All other baby equipment, bedding & linen must be provided by you.

Pet Policy

Pets

24. With so much open country The Dales is perfect for dogs and their owners, and we understand you may need to bring your dog along if you cannot find anyone to look after them while away. But please note that Dale House is not set up for pets and does not have an enclosed yard. However we would be happy to accept a maximum of 2 trained well behaved dogs per stay if you are ok to bring along whatever your dog needs. An additional charge of £25 per dog per stay will apply.
For your pet’s safety and the consideration of other guests, we do ask that dogs and their owners follow a few simple rules while they are staying:

  • Dogs must always be properly controlled and supervised. We do not have secure outside areas.
  • Dogs must not be left unattended in the holiday home.
  • Dogs are not permitted upstairs, in bedrooms or on any furniture. We therefore advise owners to bring a dog basket. This is in order to keep the house in the highest condition for all our guests.
  • Guests are asked to clean up after dogs, both inside and outside of the property, or extra cleaning costs may be charged.
  • Guests will need to bring towels for cleaning muddy paws and anything else your dog may need whilst staying at the property.

Smoking

25. You or your party are not permitted to smoke in any part of the property. If it is evident that smoking has occurred during your stay, you may be required to vacate the property and forfeit the remainder of your holiday. At the departure date no sign of smoking shall be evident at the property, otherwise a charge may be made to rectify the issue. There is a designated area outside at the front of the house where a cigarette bin has been provided.

Extra Cleaning

26. If the house requires extra cleaning above what is currently included as standard, or a deep clean as a result from your stay, we have the right to deduct an extra fee from your security deposit charged at £30/hour. The cleaning company’s word is final and will charge us accordingly. This charge will be passed on to you, the guest.

27. You may be required to verify your identity in advance of the Booking including to submit a photographic identity document and a selfie.
We may pass your details to an industry approved third-party provider to carry out the checks.

Liability

28. The house owner shall not be liable for any loss or damage suffered by you unless such loss or damage arises as a direct and foreseeable result of negligence and/or a breach of these terms and conditions on the part of the owner.

29. The house owner shall not be liable for any acts or omissions relating to the performance of the holiday contract which results from or is caused by an event outside their control. This includes but is not limited to war or threat of war, terrorist attacks or other activities, strikes, industrial actions by third parties, fire, storms, floors, subsidence and failure of public or private telecommunication networks. It is advised to have your own travel insurance policy to cover the above.

30. If an event outside our control or the control of the house owner occurs which may have some effect upon the provision or use of the accommodation, we will use all reasonable efforts to contact you as soon as reasonably possible.

Discounts & vouchers

31. Only one voucher or discount code can be used per booking. Returning guest discount codes can only be used on our website and if the property does not already have a discount listed.

Governing Law and Jurisdiction

This agreement is governed by English law and the courts of England and Wales shall have exclusive jurisdiction in relation to any disputes arising from it.
